If you are an advertiser, that is the property owner or agent placing a property adverts on this site, or a Holidaymaker, using this site to look for your future holiday rental property, you agree that by accessing or using that you are subject to, and bound by, the following terms and conditions. These terms and conditions constitute a legally binding agreement with Lupain Holiday Rentals, trading as

1. Responsibility for accuracy of the property information:

Lupain Holiday Rentals makes no representation as to the accuracy, or currency, of the information regarding individual property details contained within the website. The property details, content and uploading is the sole responsibility of the Holiday Rental Property Advertiser. Lupain Holiday Rentals has not confirmed the accuracy or currency of these details. We strongly recommend that Holiday renters make their own investigations into the accuracy of any or all information supplied. Lupain Holiday Rentals are in no way liable for any inaccuracies, misleading comments or statements made in the information provided by the holiday property owner or property agents on the website.

2. Copyright protection:

All material and software used on this site is copyright protected. Other than for your own personal use, you may not use or duplicated the material without the prior written approval of Lupain Holiday Rentals or the advertiser who listed the information on the site.

3. Copyright authority of content and photos:

The property advertiser (or P.A. referred to below) represents and warrants that he/she:
a) Owns the copyright of the photos and text material supplied by him to Lupain Holiday Rentals (also referred to as 'the Material').
b) Has been authorised by the owner of the copyright of the Material to grant Lupain Holiday Rentals full permission to use the Material as described below.
c) The P.A. grants Lupain Holiday Rentals a perpetual, royalty free licence to use the Material for promotional purposes (which also includes any marketing use and public relations material).
d) The P.A. irrevocably and unconditionally indemnifies Lupain Holiday Rentals immediately on demand against any cost, loss or liability (including legal costs) which Lupain Holiday Rentals may incur for/by reason of any breach of copyright arising from its use of the Material.
e) The P.A. understands that it may not reproduce photos or text/script material from another/any part of the Lupain Holiday Rentals website without permission from the relevant copyright owner.

4. Use of the site

A condition for all clients continued use of this site is that you agree not to use this site for any purpose that is unlawful or prohibited by any of these terms and conditions or any other applicable laws and regulations. 7. The advertiser accepts and confirms that:

a)   In relation to publicity, the advertiser, contracts with Lupain Holiday Rentals in principal, not withstanding that the advertiser may be acting directly or indirectly as an advertising agent/agents or media buyer or in any other representative capacity;
b)    The reproduction and/or publication of the information and/or data by Lupain Holiday Rentals as submitted will not breach any contract, infringe or violate any copyright or trade mark or any other personal or proprietary right of any person, or render Lupain Holiday Rental liable to any proceedings whatsoever;
c)    Any information supplied in connection with the information and/or data is accurate and true.
d)    The advertising cannot be obscene or libellous and complies with the requirements of all relevant legislation (including subordinate legislation, the rules of statutorily regulatory authorities and the law of the E.E.C.) currently being in force or applied in any part of the E.U.
e)    All advertising material/s submitted to Lupain Holiday Rentals is legal, clean and truthful and complies with the Code of Advertising Practice and all other relevant codes under the general supervision of the Advertising Standards Authority
f)    The Advertiser indemnifies Lupain Holiday Rentals and agrees to keep it indemnified against all claims, costs, proceedings, demands, losses, damages, expenses or liability whatsoever arising directly, or reasonably foreseeable, as a results of any breach or non-performance of any of the representations, warranties or other terms contained in the condition or implied by law.

8. Liability:

Lupain Holiday Rentals does not warrant that the operation of the web site will be uninterrupted or error free. Under no event shall become liable to any type of advertiser for any special, consequential, incidental or indirect damages, including lost profits, however caused, on any theory of liability, including, but not limited to, product liability

9. Advertising Multiple Properties:

A property advertisement on refers to one holiday rental property, not multiple rental units, nor example of properties in a certain region. You can only represent one unit in an advertisement unless you receive prior permission from us. reserves the right to amend any property advertisement not complying with this policy.

10. Exchanging Rental Properties:

A property advertisement on relates to one specific property. You must not substitute this property for another by way of change to the text and photos unless we have given permission to the advertiser in writing. If we find an advertiser has changed the property description for another property then reserves the right to cancel/suspend the advert in question.

11. How we use your information:

We reserve the right to use and share information concerning our advertisers, including your Internet Protocol (IP) address, with law enforcement authorities. We also reserve the right to share information with other companies, in the same industry as for the purpose of fraud prevention.

12. Payment:

When we add a rental property to the website, we require payment on that same day as registration. We will process payment, made by credit or debit card, online by our secure on-line card payment provider. Should an advertiser not have the ability to make payment by credit/debit card, bank transfer can be done the same day of registering a property. If you request a bank transfer, advertisers are required to notify by e-mail, ([email protected]), to advise us, of the expected date and time of arrival. Lupain Holiday Rentals reserve the right to remove property adverts where there has been no notice given by e-mail and if payment has not been received within the time notified.

13. Contact:

In the interest of maintaining a high level of service to holiday makers using the website, we require all advertisers to be available to respond to enquiries by either telephone or e-mail. Should advertisers be unavailable for a period longer than 1 week, then they are requested to leave an answer phone message to that effect or set up an out of office message on their e-mail account. If neither of these options is available then we ask that advertisers contact our office so that we can suspend their publicity for the time being. reserves the right to suspend or cancel adverts of owners who are unreachable for more than a week. In this instance, we will forward messages by email asking the advertiser to request activation upon their return.

14. Links:

We reserve the right to remove in any publicity, both e-mail addresses and links to outside websites. We will remove adverts with links either which, do not conform to our guidelines provided, or for which our team feel are not appropriate, or act against the interests of the company or any of its advertisers. The responsibility and authority for determining the suitability of the links rests solely with If/Should an advertiser add a link or an e-mail address without consent, re-add a link or e-mail address after its removal or remove reciprocated links from their website, we reserve the right to cancel their advertising without refund or any notification.

15. Termination:

If receives complaints from any number of site users about a specific Property Page due to misrepresentation of the property description, or any of its surroundings, then we reserve the right to remove the page without notice, then reserve the right to retain any payments. If an advertiser attempts to enter unsuitable material into the online database, or persistently misuses the on-line systems, then reserves the right to remove, the page(s) from the website, we will retain full payment in such instances. We also reserve the right to refuse or remove any page from the website that we considers unsuitable, incomplete or misleading. The advertiser will not be liable for any expense in this instance. Any page where the content fails to meet our minimum requirements, or deemed unlawful reserves the right not to allow on its website.
Should any advertisers wish to have their page removed from the website before the end of their subscription, then we will do this as soon as we receive formal notice from the subscriber by email. The advertiser may also use the 'contact us' page, quoting their owner ID or home number and password. We do not give refunds for the early removal of a subscription.

16. Changes to pricing:

Lupain Holiday Rental reserves the right to change its pricing and terms & conditions without prior notice. We will apply any change in rates immediately, to all new adverts and renewals for both new and existing customers.

17. Refunds:

Lupain Holiday Rentals provides an advertising service rather than an actual product. We offer a cooling off period of seven working days during which a customer may cancel the advert by E-mail to [email protected] or by using one of our ‘contact us’ links. You must state your owner ID or property number and your access password. We will then remove your advert from our site and refund, less a £20 admin fee, the cost of your advert.
